Article 1:
General
- These general terms and conditions apply to all contracts concluded by Cornelis Fashion bv, as well as to the formation of contracts and furthermore to all order confirmations issued by Cornelis Fashion bv.
- In the event of a conflict between these General Terms and Conditions and any General Terms and Conditions used by the Other Party, these General Terms and Conditions will prevail. The applicability of the general terms and conditions used by the other party is expressly excluded.
Article 2:
Conclusion of Agreements
- Cornelis Fashion BV will confirm the client's order by e-mail. Contrary to article 4.1 of the MITEX general terms and conditions, an order will only be made when payment has been made successfully. Cornelis Fashion BV has the right to refuse a delivery. If Cornelis Fashion BV is unable to establish the client's permanent or temporary address, an order cannot be accepted.
- Order processes that, for whatever reason, are technically or otherwise disrupted before payment instructions are completed are incomplete, even if the client has received an order confirmation. Such an order will therefore, in principle, not be delivered. Cornelis Fashion BV will, however, endeavour to contact the customer to complete the payment instructions so that delivery can take place.
Article 3:
Prices and costs
- The contract price is the current price at the time an order is placed with the online shop. The prices of items are listed including VAT.
- The prices stated in the web shop do not include shipping costs.
- Cornelis Fashion BV is not bound by the conditions of its offer in the event of a printing, typing or programming error on its website.
Article 4:
Delivery
- The delivery times given by Cornelis Fashion bv are approximate only and are without obligation, unless a certain delivery time is expressly guaranteed by Cornelis Fashion bv.
- Exceeding a delivery time does not oblige Cornelis Fashion bv to compensate any damage whatsoever. If the delivery time is exceeded, the other party may only dissolve the agreement after it has requested Cornelis Fashion bv by registered letter. Cornelis Fashion bv will then be entitled, within 10 working days, to still deliver all or part of the goods.
- If the opposing party does not accept the delivery of Cornelis Fashion bv without a justified claim, Cornelis Fashion bv may demand full performance of the agreement and/or dissolve the agreement in writing, in which case the opposing party will forfeit an immediately payable penalty equal to 30% of the invoice amount towards Cornelis Fashion bv. This without prejudice to Cornelis Fashion bv's right to claim full damages.
- After delivery, the goods that are the subject of the agreement are entirely at the risk of the opposing party.
Article 5:
Customs, excise and taxes
- The customer is responsible for ensuring that the product can be legally imported into the destination country. All orders are shipped from the Netherlands. When ordering from Cornelis Fashion bv, the recipient is the registered importer and must comply with all laws and regulations of the destination country. Orders shipped to countries outside the European Union may be subject to import taxes, customs duties and charges levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; Cornelis Fashion bv has no control over these charges and cannot predict what these charges will be. It may be a good idea to contact your local customs office for current charges before ordering.
Article 6:
Right to return items
- Contrary to article 5 of the MITEX general terms and conditions, the client is entitled to return any item to Cornelis Fashion BV within thirty (30) days of delivery, without having to give any reason. This right also extends to items that have been reduced in price. As a result, the purchase of that item will be cancelled and the client will be refunded the amount already paid to Cornelis Fashion BV for the said item. Please note that we will not refund the shipping costs for the returned items.
- No refund will be made in respect of items returned to Cornelis Fashion BV after the aforementioned thirty-day period.
- Items must be returned in accordance with the instructions on the packing slip accompanying the items.
- Items returned must be generally accepted in the condition for normal use for approval of the items, such as trying on items in conventional shops. If a client wishes to exercise such a right to return an item, the item must be returned to Cornelis Fashion BV, together with everything originally sent with it, in its original condition and packaging, in accordance with the clear and reasonable instructions given by Cornelis Fashion bv.
- Cornelis Fashion BV has the right to refuse or return a returned item to the client if the item appears to have been used, no longer bears the original labels, or damage caused by the client, or if the client does not comply with the in for returning the item given by Cornelis Fashion BV.
Article 7:
Mistake while shipping
- If Cornelis Fashion BV delivers an item that differs from what was ordered, or if the item is damaged or defective, the client should inform Cornelis Fashion BV as soon as possible. Cornelis Fashion BV will contact you about returning and crediting the item if applicable, otherwise we will come to an alternative solution.
Article 8:
Complaints
- If a customer wishes to exchange or return an item, it must follow the instructions provided on the return form, which can be received on request via email info@blue-industry.com.
- Other questions, comments or complaints relating to an order, payment or delivery should be sent in writing to the following e-mail address: info@blue-industry.com.
- The e-mail message must contain the customer's name, the e-mail address corresponding to that in Cornelis Fashion BV records, the order number included in the order confirmation and the article number.
Article 9:
Payment
- The customer can pay by credit card, PayPal, Klarna or by iDeal. All payments must be made in accordance with the instructions on the webstore pages. You will find a description when shopping.
Article 10:
Privacy
- When placing an order, the client grants Cornelis Fashion BV the right to use its personal data where necessary. These details are only kept to the extent necessary to achieve the purposes for which the details are obtained and processed by Cornelis Fashion BV, i.e. for the execution of the contract, for marketing purposes and for maintaining contact with the client.
- The personal data provided by a client will not be passed on to third parties for commercial purposes without the client's express permission. The customer has the right to inspect and amend this data at any time.
Article 11:
Disputes
- Any dispute between Cornelis Fashion BV and a client can be referred by either party to the Dispute Resolution Committee for the textile and footwear sector (Geschillenprovision textiel en schoenen).
